Nutrition Counseling for Mental Health Conditions Settlement

After an investigation uncovered the wrongful denial of hundreds of claims for nutritional counseling for mental health conditions, New York's Attorney General's Office announced it has reached a settlement with Cigna Corporation that requires Cigna to reprocess and pay hundreds of claims for nutritional counseling for mental health conditions such as eating disorders to members who were wrongfully denied those benefits.

According to the N.Y. Attorney General's Office: "Under the terms of the settlement, the company agrees to comply with Timothy’s Law, New York legislation enacted in 2006 and named for a 13-year-old Schenectady boy who committed suicide after an insurance company denied ongoing coverage for treatment of serious mental health issues, including hospitalizations."

Academy member Therese Waterhous, PhD, RD, LD, co-author of Academy's practice paper on "Nutrition Intervention in the Treatment of Eating Disorders," was among those who – through the Eating Disorders Coalition – worked with members of Congress to draft and pass the 2013 Federal Response to Eliminate Eating Disorders (the FREED Act), a comprehensive bill on eating disorders addressing research, treatment, education and prevention, which influenced the New York decision.
