New Final Rules on Subsidies for Health Insurance

The Treasury Department has issued two final rules to implement the Affordable Care Act that may unintentionally affect coverage for up to 500,000 children of middle-class families who are unable to afford their existing employer coverage and who will not be eligible for subsidies to purchase family coverage on the open market in state exchanges.

The IRS decision that financial subsidies' ability to purchase insurance will be based solely on the cost of coverage for the individual worker rather than the cost of coverage for the worker's dependents appears required by the text of the ACA itself. The Academy is monitoring the impact of this regulation on members and affected groups and will share additional information and possible legislative solutions in the future.
