HHS Proposal: Put Ball Back in States' Court for Essential Health Benefits Package

Just as states were looking to the federal government to provide guidance on the components of the Essential Health Benefits package, the U.S. Department of Health and Human Services is proposing to give states the flexibility to define benefits and services for their own citizens. The Academy has submitted written comments urging HHS to include nutrition services as a part of its forthcoming essential health benefits guidelines and regulations, and we will continue our advocacy work on the national level. HHS is accepting comments on its proposal through January 31, 2012.

Under HHS' intended approach announced on December 16, states would have flexibility to select an existing health plan to set the "benchmark" for items and services included in the essential health benefits package. If this proposal becomes final, the Academy of Nutrition and Dietetics will continue to work with affiliate Public Policy Panels to advocate for inclusion of nutrition services provided by registered dietitians in each state's Essential Benefits Package.
